As the Supreme Court revs up for a new term, the justices are being asked to tackle this question: Should pro-life activists have to pay multimillion-dollar fines for publicizing the fact that Planned Parenthood makes money by selling the body parts of aborted infants?
The court could say as early as the new term’s Oct. 2 starting date whether it will address that issue.
In a friend of the court brief urging the justices to take up the case, the U.S. Conference of Catholic Bishops — joined by the Knights of Columbus, the March for Life, and the Eternal Word Television Network — says lower court rulings imposing $16 million in penalties on the pro-lifers reflect an “all too familiar pattern” of pro-abortion bias by some lower courts. “The pattern is familiar: When abortion is involved, all bets are off,” the groups say.
The present dispute comes to the Supreme Court on appeal from a ruling by the U.S. Court of Appeals for the Ninth Circuit.
Planned Parenthood is the largest abortion provider in the country. Its 2021-2022 annual report, the most recent one available, says that in the previous year the organization and its affiliates were responsible for 374,155 abortions.
The case now before the Supreme Court had its origin in 2010 when a pro-lifer named David Daleiden learned that Planned Parenthood was selling fetal tissue from abortions to laboratories in violation of state and federal law. He and associates established an entity called the Center for Medical Progress and went to work using the methods of investigative journalism to gather evidence. Over the next several years, they attended Planned Parenthood trade shows, visited Planned Parenthood facilities, and, using concealed cameras, recorded interviews with Planned Parenthood personnel.
Then, beginning in July 2015, they began releasing their videos. Widespread media attention prompted U.S. Senate and House of Representatives investigations. Successful prosecutions followed in California and Arizona and the termination of Planned Parenthood affiliates’ status as Medicaid providers in several states.
Planned Parenthood responded with what Daleiden’s brief to the Supreme Court calls a “spending spree” intended to “stem the public relations fallout” and bolster its security measures to prevent more investigations of its activities. Then in January 2016 it filed a 14-count complaint against the Center for Medical Progress, accusing it of a “smear campaign” intended to “demonize Planned Parenthood.”
The results, says the Daleiden brief, were district court and the Ninth Circuit Appeals Court rulings — under a federal “anti-racketeering” law — that delivered “a crippling $16 million judgment” against the pro-lifers to cover Planned Parenthood’s security measures and attorney fees and punish Daleiden and the others. The brief asks the Supreme Court to find instead that the pro-lifers’ actions were protected speech under the First Amendment.
The brief by the bishops’ conference and its associates calls the Ninth Circuit Court’s decision a “transparent effort to punish pro-life advocates.” It says this poses “a serious threat to expressive organizations” like themselves which could find them liable for expenditures by other groups claiming a need to protect themselves against “speculative future harm.”
The dispute has attracted attention from free speech, whistleblower protection, and animal rights advocacy groups that joined in a brief urging the Supreme Court to consider the Planned Parenthood case in view of the potential threat to their own investigative reporting.
There is a real danger here of courts placing a lid on speech offensive to one of their own sacred cows, whether abortion or something else. Here’s hoping the Supreme Court takes a look.

Planned Parenthood has a very bad plan. Freedom of speech is being attacked.
Is there any faith issues besides Abortion that is of concern to California Catholics. I subscribed to be informed not indoctrinated about the Pro-Life stance. It appears from all your publications that there are no other important actions being taken by Roman Catholics. There is no faith only a high pressure pollical action committee.
Abortion is the most important issue facing America and the entire world today. The attack on the family is also important. How we handle these issues will determine our future. Pray the Rosary every day for the protection of the unborn and the family created by Almighty God.
So you haven’t seen all the articles about the gay and transgender stuff?

IDK if you’ve heard, but the TLA for the new LOL-worthy show on Netflix is TBA. It’s a total OMG-fest with lots of WTF moments. The MC is a total QT and the BFF is a real BAE. The plot is so cray-cray, it’s like a mashup of CSI and NCIS with a dash of SVU. TBH, I’m not sure if it’s worth the FOMO, but YOLO, right?
Hope the Supreme Court takes up Daleiden’s case– and hope it is successful. David Daleiden and his Center for Medical Progress are real heroes and martyrs for Jesus Christ and His beloved unborn children. Planned Parenthood should be ended– and its employees ought to be prosecuted and sent to jail.
WOKE JUSTICE: The guilty prosecute the innocent.
This reporting is completely dishonest. It doesn’t mention the fact that Daleiden had signed a non-disclosure agreement, which was the necessary precursor to him getting the information and video/audio recordings that he obtained at private meetings. He would not have and could not have gotten the information and recordings he did had he not signed a legally binding agreement not to disclose anything from meetings or conversations.
By revealing the information and recordings, Daleiden broke the contract he signed. The penalties awarded by a court are for damages to the other party in the agreement from Daleiden’s willful disregard of the contract he signed.
And Daleiden’s breach of the contract was premeditated. He signed the contract in bad faith, knowing that he intended to use the access subsequently granted to him to defame the other party in the contract.
So the Supreme Court is being asked to decide whether contracts entered into freely should be considered binding in a free society of laws, or whether some people are privileged or some issues are privileged such that they are not bound by contract law.
By not stating the material issue of the contractual non-disclosure agreement, this article’s reporting is a misleading failure.
I personally think Daleiden is in the wrong. Pay up. If you sign a contract, you are bound by it. Be a man. Don’t be a weaselly child.
The agreements abd laws you refer to are evil and unjust. David Daleiden is a hero for seeking to rescue unborn children who were heartlessly murdered, chopped to pieces– and their body parts sold for money. Like the totally unjust arrest and murder of Jesus Christ–for thirty pieces of silver. Expose Planned Parenthood– the heartless murderers.
Why did the editors remove my perfectly appropriate exclamation points (!) in my comment titled, “Moral cry!” (with an exclamation point after the title)?? My final sentence should correctly read: “Expose Planned Parenthood– the heartless murderers!”
What Daleiden did is as corrupt and illegal as what Hunter and Joe Biden did. All of them should be convicted for breaking the law, lying, cheating, misrepresenting.
Daleiden rhymes with Biden. Hmm….
I suggest you go sign up right now, for 40 Days for Life. Help Our Lord rescue His helpless little unborn children, awaiting death down at the abortion mills! You will soon change your poor attitude. David Daleiden is a hero and a martyr for Christ, for His helpless unborn children, senselessly slaughtered, chopped up, and their body parts sold, to make evil money for Planned Parenthood.
Daleiden is an investigative reporter, the Bidens are not, in addition to other issues that make your comparison irrelevant. Are other undercover journalists prosecuted similarly?
Today, five Pro Life activists were found guilty for violating the FACE Act, in Washington, D.C., and were led away to prison, in handcuffs, to await sentencing. Their sentences are all expected to be 11 years each, in prison. Five more of their companions will go to trial on Sept. 6th. Reminds me of the unjust convictions and horrific imprisonment of Cardinal Zen and Jimmy Lai, in China, and Bishop Rolando Alvarez in Nicaragua– and many others. My heart cries out for justice, for all of them, severely persecuted for doing God’s work. Meanwhile, violent criminals and illegal aliens who smuggle drugs and are human traffickers, are roaming loose, some of them given a mere slap on the wrist, early releases from prison, and other wrongful privileges. And evil, Satanic Planned Parenthood goes right on, daily killing unborn children, chopping up their body parts and selling them. And babies born alive after botched abortions, are left to simply die, with no attempts allowed by law, to save their lives, in many places. A horrifically unjust world.
You’re starting to get why I’m tempted to think God might not exist. He’s not doing anything to help his people. The evil are having a field day, even within the church. God does nothing.
Maybe a good priest can explain it to you correctly. How did mankind fall from grace long ago, and get into sin? What makes mankind continue to sin? How can we get out of sin? Do we need some special grace? Some special help? And do we also need to work, work, work very hard, to submit to God, renounce sin, renounce a lot of stuff that we are used to liking, and are used to having in our lives, that is all wrong? And lead a new– much harder at first– more virtuous life? God expects a lot of us. A lot. To lead a virtuous life, dedicated rightfully to Christ — to stand always for Christ and His teachings– and to even sacrifice our very lives, and die as a martyr for Him, if He asks this of you! Just like David Daleiden, Cardinal Zen and Jimny Lai, Bishop Rolando Alvarez in Nicaragua, and countless others! “Leave all, and follow Me.” Ouch! God has excellent reasons to ask you to submit yourself to such a seemingly horrible thing, like martyrdom. The true life, is actually not here, on earth– where we are actually in a tragic exile from God– but in Heaven, in Eternal Life, with God. An absolutely fabulous life, with wonders and marvels far beyond what we ever could possibly imagine. That is actually what we are being prepared for. Why would a good God send His beloved, only Son, Jesus Christ, to be cruelly mistreated and unjustly put to death, by ignorant, evil people, on a Cross– and His life seemed to end not in a glorious triumph of the Son of God– but in an apparent shockingly abysmal failure…right? The Devil, the Prince of Darkness, rules this world. And God rules Heaven. That is the truth. And we are all being purified, in our earthly pilgrimage– purified of sin, of ignorance, of all the darkness of earth– to prepare us for Heaven. And there is more. God wants to purify this earth, too, and we are to be His Christ-like helpers, to bring His Love and Light and great, Divine teachings to earth, to save souls, to bring souls to Christ. We are to be His little “earthen vessels,” imperfect but strong enough, and “doable,” carrying Him to the suffering, starving souls on earth, trapped in darkness, violence, ignorance, and sin. We have a very great mission for God, as Christians. It’s all in the Holy Bible.
