Eight state lawmakers on Tuesday urged San Francisco Archbishop Salvatore Cordileone to withdraw the “morality clauses” he unveiled this month in a handbook for high school teachers, and to reverse his intention to redefine teachers as “ministers” in their employment contracts.
The letter to Cordileone from five members of the Assembly and three state senators said the new conditions for employment at four high schools run by the archdiocese “conflict with settled areas of law and foment a discriminatory environment in the communities we serve.”
….Though the letter from lawmakers acknowledges that the archdiocese “wields discretion over working conditions” at the schools, it says his proposal strikes “a divisive tone, which stands in stark contrast to the values that define the Bay Area and its history.”
In an email, Assemblyman Phil Ting (D-San Francisco), a signatory to the letter, said: “Injustice must be confronted, no matter the source. Our society is based on the principle that we are all created equally. Any novel legal maneuvers to impose injustice must be stopped.”
The other signatories are Assemblymen Richard Gordon, David Chiu, Marc Levine and Kevin Mullin; and Sens. Mark Leno and Jerry Hill.

Though the Times story says three state senators signed the letter, it only named two.
Private Schools are none of the Legislature’s business. Go mind your own business.
Students have the right to attend public schools.
Teachers have the right to work in public schools.
Parents send their children to private schools for a reason,
and if they do not like it, they should go to public school or a non-religious private school. Issue solved.

the Archbishop of SF and others feels the need to claim the mantle of “minister” over gym teachers and janitors and cake bakers in their schools. People actually get the difference between a minister who presides over a prayer service or a Mass, and a gym teacher. And especially over a janitor who more likely than not never ever sees a student in the light of day. Call that janitor a “minister”, and let the court strike down the entire notion of the ministerial exemption.

The word “ministry” can be equated to mean the work that the church does in the world. Therefore anyone who does “ministry” is a minister.

Well, the Archbishop needs to fight this simply outrageous effort at civil control of the Church by local pagan legislators. It is highly doubtful that there is any legal basis to support the threatening letter from the Assembly Village-People. And, what did the letter mean by “settled areas of law”?
The Assembly Village-People should take a look at a number of cases, starting with Hosanna-Tabor Evangelical Luther Church and School v. EEOC, 565 U.S. ___ (2012). While focusing on a church’s unfettered right to choose its own “minister” that case has important implications here, where in the context of Catholic education, a lay teacher may teach religion (as they do in SF); other employees might also be covered. In any event, the Archbishop has every right to tell teachers and administrators what the Church stands for and what is expected of them.
The legal problem here, if there is one, involves possible post-contractual imposition of employment terms, a step (if at issue here) that is easily remedied. The Archbishop needs to ultimately require employment contracts setting out his expectations and the requirements of employment related to maintenance of the Faith. Hire Catholics, practicing Catholics, Excellency; and make them agree to adhere to Church doctrines as a condition of employment. Not given as legal advice, but only a suggestion of where one might start.

There is no such thing as entirely secular jobs in a PRIVATE religious school of any kind. All employees set examples in the specific faith for impressionable youth.
Any employee who publically violates the Faith should leave voluntarily or be fired.

Right, the Catholic Church has the right to see that Catholic schools teach the Catholic Faith. That was the primary purpose for which they were founded. She also has the right to see that the environment in those schools is conducive to transferring the Faith to the next generation. These contracts are not permanent regarding education and employment and must be renewed as stated in the contract.

I’m with the Archbishop all the way, but there is a reality out there that well, doesn’t bode well for Catholic schools in general and for those in S.F. in particular. Those who teach in Catholic schools are either single and able to live on a humble salary or married and have the benefit of another salary to make ends meet. When in the early 80s I taught at one (now defunct) Catholic high school the vice principal and at least 5 male teachers were single. Three of these were gay, including the vice-principal, and have all since died of AIDS. The vice principal was particularly hostile to the teachings of the Church on all matters sexual. A year earlier I had been a long term substitute at a well-regarded co-ed Catholic high school that had a magnificent religious ed program, daily Mass (this was 1981) available at 7:30 a.m. for any student who desired to come, and as I got to know the faculty I realized some of the most popular teachers were not Catholic and were not at all sympathetic to the teachings of the Church. They were not teaching religion, but English and other subjects. I spoke to the vice-principal at this school, a very devout Catholic, and he said the difficulty they had was finding lay people willing to work for a relatively small salary and who were faithfully Catholic.
Catholic teachers are well paid……why do you think tuitions have gone through the roof. Pray that teaching Sisters return and soon!

In your above post, you write that 3 single male teachers in the Catholic high school were gay (including the vice principal) and all 3 died of AIDS. Then you write that the vice principal was a “very devout Catholic”. It’s not my place to judge souls, and the vice-principal’s AIDS could have been caused other than by sexual activity. That said, objectively at least, the two statements are at war with each other.

He said a school that he had taught at a YEAR EARLIER as a long term substitute teacher the vice principal was a very devout Catholic. Gymn can teachers have a vast moral impact on students’ lives, often to the envy of teachers of academic subjects. They are positioned to reach children’s hearts especially those for whom sport is the very stuff of their lives. In my church we have an annual blessing for the coaches in the parish school and the whole congregation participates.
No one is forcing anyone to attend a Catholic School or be a teacher in one. Go find a job else where and quit complaining. God Bless AB Cordioleone and Fr. Illo. They deserve our support – not our criticism.

Ting’s office, the focus of their conversation (defense) is about “collective bargaining” and that the teachers employed by the AD’s would not be “protected” – The whole argument is ridiculous and someone in the AD needs to call them out on this and explain that it doesn’t apply.

The Important point I see is that Teaching is Properly regarded as a Ministry of the Church, regardless of whether the class has any ‘Religious’ Connections to the subject matter.
Aside from the basics of Christian Scholars treating each other as brothers & sisters in the Lord, and recognizing that all are both the children of their parents & God’s Children as well – Catholic Teaching is Supposed to follow the lead of the Great Teacher Jesus in the classroom as in life.
Not always easy, nor popular – but wherever Classrooms have (or should – too many now omit) the Cross of Christ on the wall, then a higher power and instruction than the State takes precedent.

The USCCB grant funded charitable groups are not related to the Diocese (although they operate all over the place).
I also would like to see the USCCB, and their CCHD, Catholic Charities, and CRS – not be allowed to collect government funds of any type. (I would propose this legislation myself, and I am Catholic.)

It is a good question ElizabethM poses: where are the other CA bishops? Barber is doing the right thing across the Bay. What about the others of the Golden State? While San Francisco’s schools may be especially corrupted due to the brownshirts of SF and Marin and Catholic flight to the suburbs, SF schools are not uniquely corrupt: we know the parochial school system of this state are shot through with doctrinal corruption.
I’m going to back away from one assertion I made: the role of collective bargaining in the high schools. Never having worked in one, perhaps these contracts are multi-year ones, which is different than the parochial schools’ year-to-year contracts. It never occurred to me that the HS system might be different. I will have to ask my sources.

An interesting aside, for attention of Assemblyman Ting/Others, regarding attempting to legally define, and enforce, a “City’s opinion” against the Constitutional protections of Free Speech, Freedom of Religion, Equal Protection, and all those principles hated by the Zombie-Liberals. Take a read of the 54-page complaint filed in Federal Court in Atlanta, Cochran v. City of Atlanta, Mayor Kasim Reed, et al., on February 18th.
There are many issues, and wonderful facts, raised by Plaintiff Cochran (the highly decorated ex-Fire Chief who was fired for exercising his fundamentalist Christian beliefs, which included expressing his views on homosexual sex). In a letter seeking support from his friends, leaked to media this week, accused child pornographer Benjamin Levin admits that he asked a mother “to sexually assault her child for him.”
The letter provides the first comments the public has heard from Levin since his July 2013 arrest on child sex charges.
As deputy minister of education under Premier Kathleen Wynne when she was minister of education, Levin was the top bureaucrat in the department as the government developed the controversial sex ed curriculum that critics believe prematurely sexualizes children.
Levin wrote in his leaked letter that he intends to plead guilty on March 3 to three of the seven charges.
Thirty-five years ago, a Presentation nun informed me that the Catholic Church should never receive funding from the government, either local or federal, because then they would be able to control the Church. When I was in the seminary, the Catholic university I attended, had no visible signs at the campus, that it was Catholic. There were no religious statues or crucifixes to be seen anywhere, except in the chapel. This was because government grants were given to the university. Big Brother government wants to run everything, while they cannot even run themselves. I hope that Archbishop Cordileone will not cave to these liberal monsters who want to remake the Catholic Church in their perverted image.
Agree with you Father Karl! We must all stand up and be counted for our Faith that we are Members of the Mystical Body of Christ! That Body is “Dazzling White.” It is the presence of God. “God is light, in Him there is no darkness, none at all.” Thus, no Catholic who is a Member of this Mystical Body could every submerges oneself to the mires of the worldly. The Church is Holy, those who choice to live with unholiness are not of our Faith. They should all leave and join other churches which are in agreement with their life style and ways of thinking. “Heaven and earth will pass away, my words will not pass away.” Jesus’ words is Everlasting for evry Faithful Roman Catholic. Everyone is free to choose where they want to live and with whom they like to work for/with. Anyone whose thinking is in disagreement with the Catholic Church’s teaching, should not apply to work for the Church in any form or shape on a job; especially at a teaching position, where the Church Doctrines must be taught and lived. Why create problems for self and the employer, to be on a job and a place where one is unfit? Unless there is a purpose, trying to infiltrate into the company so to destroy it from within!? if that is the case, it is a premeditated Evil, that is both immoral and illegal; deceiving the employer! Honesty is required at any job. The Church’s mission to instruct Her Faithful to be better citizens in this side of life for other side of Life that is Life Eternal No different than the Islam wants only to teach the Islamism and none other. The President even allow his Islam follow 0faithful to worship in the front of the White House, while no other religion were allowed.

The very wise and holy Presentation nun saw the clear future handwriting on the wall. Trade offs in the mix. The minute you forget that “all graces” and “all blessings” come only from God, you are in deep trouble. You cannot selectively tap dance with the devil and then not expect to lose something in the end for having the close and dependent affiliation. Little by little by little and inch by inch God will be pushed out and you will end up being controlled because of seeking outside means of blessings and support from a Godless government. There is no such thing as a free lunch. The chicken have come home to roost after all of the years of compromising the faith in order to receive funding from the government. There are also those within the Church who are actively working to push God out even more.

Did the Archbishop break a law by putting a page of Catholic Doctrine in the teacher’s handbook of a Catholic School? Especially when it is acknowledged from the beginning that all employees would not agree with it.
“We, the Archdiocesan High Schools, Acknowledge that some of our administrators, faculty or staff may not be Catholics and some may be Catholics who are struggling to achieve fidelity to some of the teachings of the Church, but we are all nevertheless called and required to stand as effective and visible professional participants and proponents of truly Catholic Education. As effective professionals in a Catholic School setting, we all – administrators, faculty and staff – are required and expected to avoid fostering confusion among the faithful and any dilution of the schools’ primary Catholic mission. Therefore, administrators, faculty and staff of any faith or of no faith, are expected to arrange and conduct their lives so as not to visibly contradict, undermine or deny these truths. To that end, further, we all must refrain from public support of any cause or issue that is explicitly or implicitly contrary to that which the Catholic Church holds to be true, both those truths known from revelation and those from the natural law.
It is FRAUD to advertise any school as “Catholic” – if all employees do not teach and adhere (teaching by example) to the Catholic Faith.
Taking funds (tuition, book and other fees) in any other case is FRAUD which is STEALING and violates GOD’s 7th Commandment.
Perhaps we need to start suing fraudulent Catholic Schools. Just like those children who had been abused had to sue the Diocese.

There is a very worthwhile book entitled INDEX OF LEADING CATHOLIC INDICATORS, authored by Kenneth C. Jones, and published in 2003 by Oriens Publishing Company, St. Louis, Missouri. Patrick J. Buchanan wrote about this book, ‘Liars may figure, but figures do not lie”. He also states that “Through the papacy of Pius XII, the Church resisted the clamor to accommodate itself to the world, and remained a moral beacon to mankind. Since Vatican II, the Church has sought to meet the world halfway. Jones’ statistics tell us the price of appeasement.” Therefore, when you play with fire, you get burned, and if you wrestle with a pig, you get dirty. The Catholic Church appears to be burning, with the filth of the world feeding the fire. Mr. Buchanan also states that Vatican II has proven to be a blunder of historic dimensions. It is totally foolish and naive to believe that a Council could reconcile Catholicism and modernity.
