This comes from a January 29 story on Fox News.
A Rancho Cordova man is in the Sacramento County jail on a no-bail hold, accused of attempting to kill a fetus. Police say 27-year-old John Collins hit a pregnant woman in the stomach with a baseball bat.
According to Elk Grove police, Collins and the pregnant woman have a child together, and they arranged to meet in an Elk Grove residential neighborhood on Saturday for a custody exchange.
“They got into a verbal argument,” explained officer Chris Trim of the Elk Grove Police Department. “During that argument, Mr. Collins pulled out a baseball bat and began smashing out the windows of the vehicle that the victim in this case had been driven up in. Inside that vehicle were some small children and additional witnesses to the event.”
According to Trim, the woman got away in the damaged vehicle, but the suspect followed her to a nearby retail parking lot where the confrontation resumed.
“During that time, he armed himself with a baseball bat again,” said Trim. ”And, according to the victim, swung the baseball bat, striking her in the stomach. She is seven months pregnant.”
In addition to attempted homicide, Collins is charged with domestic violence, assault with a deadly weapon and making death threats.
The woman was taken to a local hospital. She and her unborn child are said to be okay.
According to California Penal Code 187 (a), ”Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.” A similar federal law went into effect in 2004, known as the Unborn Victims of Violence Act, or Laci and Conner’s Law.

It’s only murder if the death of the fetus wasn’t the result of an Legal abortion. Our crazy unGodly laws.
Oh my gosh I know right?! As long as its a “wanted” human people care and laws count: I mean don’t get me wrong, anything to protect the unborn, but what hypocrisy!
Just think, if John Collins was a doctor, licensed to perform abortions, and the above mentioned woman had no relation to this man and paid him to perform an abortion on her, Collins could legally tear the limbs from the baby’s body (inside the womb of course) and it would be completely legal. What it really boils down to is this, if the child is wanted then it’s murder if the child is unwanted it’s an abortion and not murder. And Jesus wept.
That’s right Loraine : )
Loraine, Excellent response!
This is tragedy. God have mercy. Poor innocent baby, I hope that this woman and her baby are well and that they get the protection that they need to thrive. It’s very scary, poor woman, she had nothing to protect herself with. What a coward, fighting with a bat against a pregnant woman, surely not a true man at all. Even if he didn’t have a bat to harm her, I’m sure he is stronger still.
We won’t know for a long while if the unborn child is okay. He or she must first be born, and as time goes on, assessments will be made. The man belongs in jail for a variety of reasons, and attempted murder is only one of them. All murderers belong in jail, even those who murder our children under the sanction of our twisted laws.
I pray for this poor woman and all women who get involved with “men” that will not accept their responsibilities to love and protect all women and the children they produced. He is evil and self serving. I hope they throw the book at him.
I pray for the poor children that were terrorized in the car. Poor innocent babies. May God protect them all.
This is what happens when you have a society that does not believe in moral absolutes. As ‘citizen Bob’ becomes inured to an ever capricious judicial system he begins to wonder why you have to pay someone to murder your child when you could do it so much cheaper with a kit obtained on the internet, and why just a child in the womb, and why not one’s parents when they’re old and feeble and useless, and why not one’s wife who does nothing but nag nag nag, and why not one’s neighbor who has loud parties and is out of work and is of no use to society? When it’s anyone’s opinion is as true as another’s, whose moral authority shall make the final decisions about anything? If it’s just my word against yours, why should I listen to any law at all? There are people who contribute here that believe that no law should be based on a monotheistic belief system … that it’s all based on a secular understanding. With the ACLU pretty much calling all the shots, as lawyers have hijacked this country, this is going to be small potatoes … a man killing a baby … when 55,000,000 have been killed with due process of law. Just what do people expect? Morality? Justice? Goodness? Mercy?
People are going into achools, movie theaters and restaurants and wantonly killing people and the pathologically clueless and amoral liberals are going after guns. That’s like trying to limit the supply of cyanide gas to stop nazis from exterminating Jews and Catholics.
Yes indeed, Dana. Even when people go into movie theaters to be entertained and (surprise!) are not slaughtered by other people enslaved by pure evil, they are subjected to films depicting insane levels of evil and violence, and no one flinches. Does not the beautiful portrayals of senseless murdering, hip vulgarity, shameless exploitation and degradation of women, and uncaring sexual encounters between unmarried teens and adults teach audiences around the world that these actions are now free of moral penalty and have no consequences for human beings? In a half-step more, we see people assume these behaviors throughout society, and as long as the murdered are very small, and as a society, we communally do nothing, say nothing, see nothing. We are unmoved. Dana, you are right: the inconvenient child is murdered Monday through Friday without consequences, and the useless, tiresome, unhealthy, unattractive and annoying and demanding among us are next to be dispatched without mention, remembrance, or concern. No funerals are in order for the inconvenient child, who shall return to God unnamed, unloved, unwanted, and inconsequential, except to God, who loves each of us for eternity.
Excellent post, Dana.
Thanks Maryanne and Anne. At least in this case there is a happy ending and the precious little one and his mom survived. Let’s keep praying for them.
Luckily, the woman and her unborn baby are o.k. What makes this a crime is that a doctor did not try to kill the child in an approved building and the woman wanted her child. The right of life should not be decided by the mother’s desire for her child. Just like the right to life of the born should not be determined by the mother.
I notice the law says “or a fetus” and not “including a fetus.”
The law says a lot of things, as it has a lot of realms to it, one realm for each area of diversity … sort of, you might say.
If a child in the womb has the right to life (i.e., this man can be charged with attempted murder), then that child in the womb HAS THE RIGHT TO LIFE.
It’s so darned schizo for our country to say the child can be killed if the parents want it done — but then our country arrests someone for attacking her while she’s pregnant. Talk about mixed messages!
Mackz, are you calling “diversity” “schizo”? Which realm of law contains which “right to life”?
I need to say something else here. When are women going to learn not to have sexual relations with such men as this? If they do not care enough to marry you, they really do not give a damn about you, including your child.
I think because girls are no longer being taught to value themselves and their virginity they feel it doesn’t matter. Everyone else is doing it…they see all the ‘popular’ and attractive people doing it on movie screens and televisions, so it’s no wonder they don’t question that it’s okay to have sex with someone you just met. Also, I think promiscuity often comes from early sexual abuse and more girls have numerous step-dads and boyfriends of their mom’s to deal with, don’t you think? I suppose, as in ages past, the pendulum will swing back and there will be a Victorian or Puritan backlash. (We just don’t see any sign of it yet. ) I suppose when they awaken to the consequences, like STDs and pregnancy, they begin to face reality.
