Supreme Court Justice Samuel Alito says the Covid-19 pandemic has brought “previously unimaginable restrictions on individual liberty,” warning of an important shift in the views of essential rights on several fronts, from religious freedom to free speech.
Alito’s remarks came Thursday in a keynote speech at the Federalist Society’s annual National Lawyers Convention, which is being held virtually this week. The event’s theme is to examine how the coronavirus is affecting the rule of law.
The Covid-19 crisis has “highlighted constitutional fault lines,” Alito said.
He cautioned that his statements shouldn’t be taken as a judgment on whether numerous coronavirus restrictions reflect good public policy.
“All that I’m saying is this, and I think it is an indisputable statement of fact,” the justice said. “We have never before seen restrictions as severe, extensive and prolonged as those experienced for most of 2020.”
“Think of all the live events that would otherwise be protected by the right to freedom of speech,” from lectures and meetings to religious services, Alito said. He also noted that the pandemic has affected access to the courts and the constitutional right to a speedy trial.
“The Covid crisis has served as a sort of constitutional stress test,” Alito said. “And in doing so, it has highlighted disturbing trends that were already present before the virus struck.”
The Supreme Court justice then ran down a list of examples that, in his view, reflect shifting attitudes toward long-held rights in the United States.
First on the list was what Alito called “the dominance of lawmaking by executive fiat rather than legislation” – actions that he said range from agencies’ broad use of regulatory power to the use of executive discretion to impose sweeping restrictions in the name of fighting a pandemic.
Alito later cited a legal case in Nevada, saying the governor’s emergency orders in that state have given leeway and support to casinos hosting gamblers at up to 50% capacity while forcing houses of worship to cap their attendance at 50 people.
“Take a quick look at the Constitution,” Alito said. “You will see the free exercise clause of the First Amendment, which protects religious liberty. You will not find a craps clause or a blackjack clause or a slot machine clause.”
“It pains me to say this, but in certain quarters, religious liberty is fast becoming a disfavored right,” Alito said. He ran through several religion-related Supreme Court rulings, including the Little Sisters of the Poor (over providing birth control to employees) to Masterpiece Cakeshop in Colorado (over the refusal to make a wedding cake for a gay couple).
Alito made a direct connection between America’s ongoing “culture wars” and the pandemic crisis, citing a 2016 blog entry by Harvard Law School professor Mark Tushnet.
“He candidly wrote, quote, The culture wars are over; they lost, we won,” Alito said.
He went on to quote from Tushnet’s much-discussed stance that “[m]y own judgment is that taking a hard line (‘You lost, live with it’) is better than trying to accommodate the losers. … And taking a hard line seemed to work reasonably well in Germany and Japan after 1945.”
Alito went on to quote Bob Dylan: “Is our country going to follow that course? To quote a popular Nobel laureate, ‘It’s not dark yet, but it’s getting there.’ ”
The justice described what he called a “growing hostility to the expression of unfashionable views.” As an example, he cited the Supreme Court’s landmark shift on same-sex marriage.
“You can’t say that marriage is a union between one man and one woman,” Alito said. “Until very recently, that’s what the vast majority of Americans thought. Now it’s considered bigotry.”
Protecting freedom of speech will be one of the Supreme Court’s greatest challenges, Alito said.
“Although that freedom is falling out of favor in some circles, we need to do whatever we can to prevent it from becoming a second-tier constitutional right.”
Alito called out a group of Democratic senators who weighed in on a gun-rights case in New York, saying they had attempted to bully the Supreme Court. The group filed an amicus brief calling the court “a sick institution” that might need to be restructured. Alito said he viewed it as “an affront to the Constitution and the rule of law.”

Just today, on ABC’s This Week, Marth Radditch interviewed three Texans who refuse to wear masks, and said that they just don’t work for “a tiny microbe”. Except that masks do help. Do they prevent transmission? No. But they significantly cut down transmission. Just ask the 130 Secret Service agents who either had the virus or who can’t go to work because they were around people who utterly made not wearing masks a badge of honor.
We are going to see a quarter million new cases a day, before Thanksgiving. It may double again before Christmas. By the end of the year, we could have more people die every day than who died on 9|11.
But it didn’t have to be this way, and it doesn’t have to continue on this path. But it takes the cooperation of people, instead of a politicization of the issue. Take care of yourselves and others. Mask up, stay outside and several feet away from each other. Postpone your personal Thanksgiving celebration for six months, but use this November to give thanks that you have saved your life, those you love, and people you will never meet.

We do have a pandemic that has killed over a million people worldwide and nearly a quarter of a million in the U.S. The estimate is that 35,000 more will die before the end of the year. To date 11.1 million people have contacted the virus and 246,000 have died from it, and it is spread across all age groups except the very young. If the virus goes unabated and only infects 30 million people, that will likely result in 600,000 deaths. It seems to me that if we can save one life it is worth the trouble of wearing a mask so that I reduce the chances of infecting someone, keeping my distance from others, and not meeting in big crowds. Thanksgiving at my house this year will only involve7-8 people. Hopefully next year we can have the usual 20+. Stay safe and keep others safe.

What is not being told here is that young people who are being treated for HIV are doubly at risk of dying from COVID 19 than young people who are HIV negative. The practice of sodomy, by homosexuals or heterosexuals, and the misuse of alcohol and illegal drugs are very high risk factors that many do not want to mention. I have no doubt that any STD is a risk factor, but deviant practices are far more so. Dr. Anna Maria Geretti did a study about this, and said that the ingestation of fecal matter is a strong contributor. That is not something we want to hear about, but something we all need to hear about.

Tom, to your questions: 1) No, 2) No, 3) No. But those questions have nothing to do with the speech the Justice gave to The Federalist. Justice is supposed to be blind. We are supposed to be a country with justice under law. A Justice is not supposed to publicly state his views on issues that might sometimes come before the court. If he or she does, they should recuse themselves from the case.
Did the same rules apply to RBG? I don’t recall her ever recusing herself even though she made frequent expressions of opinion in other than judicial settings.

The remarks above by yfc, reflect that once again, yfc is repeating Media News headlines, rather than facts based on correct and accurate data. That the Media does little or no research now, is obvious. The correct source for data is the Center for Disease Control, or CDC. There it can be seen, from CDC mortality tables, that during this year, there was a cv peak in the overall deaths, (deaths from every cause, including cv) followed by a smaller peak, and that overall mortality has now decreased to baseline, that is, it has returned to the average number of deaths. Of course it is very difficult for most people to look at mortality tables, because this could involve our families or ourselves. There is a very real and normal human aversion to death – most people cannot face it directly, and cannot read the death data presented in Mortality Tables. Yes, we might die of cv, but also, there is cancer, heart disease, accidents, or other problems. But if you intend to present an accurate account of cv, one must do this, and reference accurate data tables, and not the Media. The impression is that the Media has no one on their staffs, who does investigative research, consults accurate data, and comes to an objective conclusion.
To return to the data, so far, it indicates that of the people infected with cv, 99.5%of people survive, and for those under 70, the survival rate is higher, 99.95%, and that the overall Mortality Rate has again dropped to normal. Once again, it is distressing that people die of cv. But that is life. We all have to face the more difficult threats of accidents, cancer and heart disease, and that all humans must die. It is difficult, it is distressing, but we must face cv in the same manner. We cannot continue to damage the education and employment prospects of young people, based on Media headlines.
The news media is reporting facts that they accumulate from local public health officials on a daily basis. Much of it is also accumulated by places like Johns Hopkins University, not “the Media”. CDC mortality tables are weeks and weeks late.
It is also not true that 99.5% of people infected with the coronavirus survive. The number is more like 98%. But no matter, if 100 million Americans get coronavirus, even using your statistic, we get to half a million dead.
Johns Hopkins University – not The Media – says as of today there are 11,000,000 confirmed cases of COVID-19 in the United States since the beginning of the pandemic and at least 246,000 people have died so far. Of course, of the millions of those who got it recently, they haven’t all survived yet. There are tens of thousands of deaths yet to come of people who are currently infected. That gives a mortality rate of more than 2.2% or a survival rate less than 97.8%. By that number, if we have 100,000,000 infections, we will have over 2 million American Dead. That is not “The Media” that is Johns Hopkins University. But hey “that is life”. I thought we were supposed to be pro-life not pro-death.

Let’s begin: The “Johns Hopkins data” that you gave, are not correct.
For one thing, in compiling supposedly accurate data, a very questionable device called “PIC” is used. That means, that all
deaths due to pneumonia and other influenzas, are counted as cv deaths. And to add to this, Physicians are instructed that
if there is any question at all, please state the cause was cv. Most people do not know, that other influenzas are also deadly,
and that for example, some years back, 400,000 people in the US were hospitalized with (other) flus, with 80,000 deaths.
This means cv values are now being greatly increased, with flu and pneumonia data.
Another point: CDC states that it takes about 8 weeks for all data to arrive at their site. Since the peak death rate was back in April, that means the data figures are nearly complete through the first week of October.
Third point: Why CDC data are the best: Most important, the figures are taken from actual death certificates. That means that they are Hard Data, actual real numbers, and not somebody’s guesswork. And most interesting, one data parameter,
“Death from all causes” (that must include cv) does not show these inflated values. How can that be? If the Total Cause data does not show these high values, then how can the cv death total be much higher?
To sum up, there are reasonable doubts about the continued ongoing attempts to shut down business and society,
with the cause given as cv. These problems should be addressed, and not avoided and replaced with Media speculation.

Dear YFC: My remarks definitely have validity, and a source: The CDC. This is real data, hard data. The reason is that CDC collects their data from US death certificates. This data, is once again, is much more real than the projections of Johns Hopkins. On the Johns Hopkins website, they are most concerned with cv infection rates worldwide, and in the US. Their discussion of deaths due to cv are very short, and do not provide any information as to how they accumulate and estimate the figures. For example, under the Mortality section, there is a paragraph or two, but once again, their approach is the visual and general display of data, many graphs. No one is disputing that pictures, displays, and graphs are valuable.
The question is: How does Johns Hopkins actually accumulate data and what is the basis for their calculations? The impression is that they are general estimations based on projections.
The CDC data is not vague. It is clear cut, hard stuff. One cannot argue with a death certificate. That person died. Now, if one graphs this CDC hard data, you can clearly see a baseline value, average deaths over the year, which is in the US, around 8000 people each day, or about 56000 deaths over a one-week period. Next, the graph shows a rise in the death rate, which results in a peak in April, and a secondary lower peak later on. Those peaks are presumed due to cv, but they do not show the higher values given by Johns Hopkins. Again, the graph data are CDC actual Deaths From All Causes, not projections or estimates. And finally, the graph shows that after the secondary peak, the mortality rate returns to baseline, that is, the average value of around 56000 over a week period. That is where it is at present – baseline, or normal. It will be interesting to follow over the next few months. There may be again, more smaller peaks, but these may be due to the usual mortality rise in winter, due to pneumonias, flus, etc. Will there be a another cv peak?
So that is where we are at present: Normal Baseline.

Johns Hopkins isn’t using “projections”. They are reporting cases in which a person has tested positive for COVID-19 usually via a PCR test. That IS hard data. Death certificates are another form of hard data. Hopkins is NOT measuring pneumonias and flus caused by anything other than COVID19.
If you go to your doctor and they find plaques in your arteries, do you want to wait until your death certificate is processed before you do something about it? That is kind of what you are suggesting.

YFC: To sum up: Testing positive for cv is not equivalent to actual deaths. This virus, cv, appears to be following the traditional behavior of a new virus. When it first appears, those humans who are very aged, weak, or infirm succumb to the disease. As time passes, more and more of the population gets the virus and and so acquires immunity. When enough are immune, the virus dies back, and disappears. CV appears to be following this traditional path. US Deaths from CV peaked in April, followed by a second peak in August. Since then, in September and October, the US actual death rate from all causes, has dropped to the average baseline value of 56,000 deaths per week. That means the death rate has been at baseline normal through October. Since, as CDC states, it takes 8 weeks for most of the data to be posted to CDC, and tabulated, there still has not been enough time to ensure that cv is no longer at epidemic levels. In order for this normal flat baseline death rate to be accepted, we will have to wait through several more months.
However, looking at the graph, it appears that cv has now dropped, and is now flat and steady at the average baseline level for two months
It will be more difficult to assess later, because the death rate for other reasons rises during Winter months, due to increased levels of pneumonia or flus.
Of course, this is a first estimate, but the graph suggests cv is no longer at Pandemic levels, and so extreme measures like masking are no longer needed.
I thought it was recognized law that free speech does not include the right to shout FIRE in a crowded theater. The COVID epedemic is real and, in many cases, deadly. Perhaps some in authority have been a bit too zealous. I prefer this to even worse COVID statistics.
