The head of the U.S. Conference of Catholic Bishops’ marriage defense efforts has offered his support to a suggested constitutional amendment to define marriage as the union of a man and a woman.
“An amendment to the U.S. Constitution is the only remedy in law against this judicial activism that may ultimately end with federal judges declaring that the U.S. Constitution requires states, and consequently the federal government, to redefine marriage,” said Archbishop Salvatore Cordileone of San Francisco.
The archbishop, who chairs the U.S. bishops’ Subcommittee for the Promotion and Defense of Marriage, voiced his support for such an amendment in a Feb. 19 letter to Rep. Tim Huelskamp (R-Kan.).
Last July, Huelskamp introduced a Marriage Protection Amendment in the U.S. House of Representatives.
Amending the U.S. Constitution is a difficult process; only 27 amendments have been ratified in the nation’s history. To be formally proposed, an amendment must first have the support of either two-thirds of both houses of Congress or a national convention called by Congress at the request of two-thirds of the state legislatures. It must then be ratified by either three-quarters of state legislatures or three-quarters of special state ratifying conventions.
In his letter, Archbishop Cordileone pointed to a variety of federal challenges to “the constitutionality of state marriage laws that honor the reality of marriage as the union of one man and one woman.”
Just this month, he said, “a judge for the U.S. District Court for the Eastern District of Virginia ruled Virginia’s marriage amendment unconstitutional,” following a similar ruling for the U.S. District Court for the Northern District of Oklahoma.
“Both of these decisions are part of a trend that began last December when a judge for the U.S. District Court for the District of Utah declared Utah’s marriage amendment unconstitutional,” the archbishop explained.
Rulings in Kentucky and Ohio also show that states may face increasing pressure for “recognition of out-of-state same-sex ‘marriages,’” he said.
“Given the litigation pending in federal courts around the country,” Archbishop Cordileone warned, “more bad decisions using the U.S. Constitution to strike down state marriage laws may be on the horizon.”

While I support the constitutional amendment approach, it is short sighted to think that this is the only way to curb judicial activism. Look how the constitutional amendments we have always enjoyed, are now being shredded before our very eyes by those in all the branches of our government (who have sworn to uphold the constitutional) .
I pray for the day when all of our bishops and priest boldly speak out against the contraception mentality which has so crippled our nation and has contributed largely to the destruction of marriage and the family in our country. Look at how divorce, one product of contraception, has empowered our courts over numerous adult’s and children’s lives in our nation. To think that a little pill or a little snip-snip, which we were promised would “free us” has in reality enslaved an entire nation, not to mention the world!

I doubt Cordileone can do this with his “style” – he likes the glamorous acts but not the unseen and he sure is making progress with building his own “Cordileone’s Catholic Church” – of course, with the help of Pope Emeritus Benedict (really retired?), Fessio, Levada, etc. Too bad they do not get the way of PF.
The Marriage Protection Amendment sounds like a good idea! However, what is also greatly needed– is for all the churches to firmly stand behind Christian teaching, and work very hard to totally obliterate the post-1960s filthy “hippie society,” with absolute conviction, and no compromise! PERIOD!! Our Church needs a total change of policy, as to how the Vatican wishes to run Church affairs! Will the Pope agree to firmly set aside the present approach– and to firmly and enthusiastically teach, preach, and carry out all Church affairs– by ONLY CATHOLICISM? And NO BALONEY?? Let’s see it!! Many Catholics of today, have never been taught their Church’s Catechism, and have NO CONCEPT AT ALL, of what Catholicism really is!! Our Church has been nearly annihilated, since Vatican II!! There is no respect nor understanding of Marriage in today’s society, and many young Catholics are totally illiterate, on this subject!! And just look at the horrific problem with the so-called “hook-ups,”as well as abortions and contraception, on Catholic college campuses!! A HORROR, before God!! Breaking up the Canon of the Mass to shake hands, holding hands during the Lord’s Prayer and other practices must be stopped.

We should all knee to receive our God in Holy Communion. This shows the respect due Him.
Brian, I am in agreement with you that it would have been preferable if the only thing which changed in the post Vatican II Mass was the language. This would have been much easier and less disruptive to accomplish, as the Latin had already been translated into the local language allowing the people to follow along in their Missals.
I think that most people younger than 45 years or so of age do not realize that the rubrics and practices currently happening in the new Mass were not what was initially instituted either. For many years only the priest read scripture, which included reading the Epistle from one side of the sanctuary and the Gospel from the other. We all still knelt at the altar rail and received our Lord on the tongue, which was administered only by a priest. (I believe this changed in the late 80’s or early 90’s) Woman still wore head coverings, etc.
It seems that each decade since Vatican II ushers in more alterations to the rubrics of the Mass. As far as confessions becoming readily available “face to face”, this was started around 1980. I suppose there are those who might argue that the Holy Spirit is still trying to figure things out :(

As long as Catholics and others continue to support the Democratic Party of Death (Democratic Party includes abortion, and support for sodomy marriage in its National Platform), and VOTE for any poliitican of any Party who publically supports immoral activity – including their public votes, then there is no hope for a Constitutional Amendment.
The key is in our election process and the education of the voters.
Immoral politicians appoint immoral persons of like mind to positions of power.
The President and Judges who violate the Constitution by imposing their own positions, rather than merely enforcing existing law – should be impeached and removed from office.
All Legislative Powers shall be vested in a Congress of the US – Article I, Section 1.
Judges shall hold their power during “good behavior” – Article III, Section 1.
The USCCB and all Diocese Bishops should start preaching from the pulpits that it is a mortal sin to vote for any politician of any Party that supports abortion, sodomy marriage.
And they must publically correct Catholic politicians who give scandal by voting for abortion and sodomy marriage. Canon 915 & Canon 1399.
We must clean up our own house first. US Bishops must set the example.

Calling a constitutional convention to amend the Constitution may be the most dangerous path to change in our system. A properly constituted convention can take up any issue it wants. It would not be limited to the one issue that so many want to change. It could in fact, change the whole constitution and thereby change our society. We need to be careful what we wish for. We need to stick to the basics of how our government runs. There are three equal branches: Executive, Legislative and Judicial. The Executive branch, unlike countries with a Parliamentary system serves as both head of government and head of state. The primary function, in addition to foreign relations is to implement the laws passed by Congress. The Legislature is responsible for passing laws. The Judicial is responsible for settling complaints between States and determining the constitutionality of the laws passed by Congress and the rules and procedures promulgated by the Executive. This is Freshman Civics class (if they still teach Civics?). There is great wisdom in the fact that there have been so few amendments after the original ten, the Bill of Rights. The Constitution has served us well over the centuries. We mess with it at our peril. Let’s find other solutions to the problem.
Bob One, from where does the EPA, NSA, IRS, Department of Education, etc. derive their power to enact their countless regulations? The individuals running these departments are not elected, yet they hold unconstitutional authority over us.
Think back to when you were a boy or young man and ponder the freedom you and others had in your lives compared with all of the regulation you or others now encounter on a daily basis. Your text book explanation of the “separation of powers” is an old song the majority who hold power over us have long ago forgotten.
If these agencies are acting with unconstitutional authority, how about citing an example or proving it in a court instead of just asserting something that amounts to a soft treason.

If the FCC isn’t silencing speech, the IRS will! In the run up to the 2014 elections, the President’s party can’t hide from its scandalous record during the 2012 elections, but it can certainly keep the opposition from talking about it.
Under a new proposal, the IRS would subject lobbying groups like FRC Action… restricted in helping churches register their members to vote, but we would be limited in distributing voter guides that show where the candidates stand on the important issues involving you and your family.
Obviously, the goal is to drive these groups out of business by making it too difficult to operate, just like the IRS targeting of conservatives did in 2011-12, arguably impacting the outcome of that election…
As recent history has shown us, this gives the Left the opportunity to harass and intimidate donors to conservative organizations until there is no opposition to their radical policies.
The effect is an information blackout, where candidates won’t be held as accountable for their votes…
The IRS needs to be accountable to “We the People.” You can help by providing public comment to the IRS to let them know that these proposed regulations are restrictive and chilling on grassroots citizen groups and everyone’s freedom of speech.
I hope you are successful with your topic. Based on experience, Roman Catholics practicing tradition can find preaching to the liberals and getting frustrated going nowhere with them. Only through fervent prayers (perhaps for years like St. Monica prayed for St. Augustine) to the Holy Ghost will the scales fall from the liberals eyes. Only the Holy Ghost has the power to change their vision, see clearly, and change their minds to follow the truth. Pray the rosary for restoration of Holy Mother the Church and world peace.

Anonymous, great comment and this is what I have tried to say over the last year. We had the AB in Oakland, he did very little and the new Bishop is now faced with the almost impossible task of getting things back in order. Time will tell. I can’t help but wonder if the AB believes that he is on some kind of fast track to a ‘Red Hat’. I think that we can all agree that there is too much politics within the Church today the majority of these leaders play games.
Fortunately, our Pope has recently denounced this type of careerism. To say that the Abp. did “very little” while he was here in Oakland is being pretty generous. While he was flying all over the country denouncing the HHS mandate, someone pointed out to him that Catholic Charities East Bay covered its own employee for contraception, a long-recognized fact the Abp. later admitted to in the diocesean newspaper—it’s really difficult to imagine climbing to a greater height of hypocrisy. Nothing was ever done to correct this.

Reminding everyone here that Brinkin was given the honors and positions before anyone had any inkling of his pornography problem. Senator Mark “Kiddie Porn King” Leno strikes again – just in time for Larry Brinkin Week celebrations in Sodom by the Sea:
1,378 new CA bills, including a new attack on Prop. 8
California lawmakers, bent on beating the Feb. 21 deadline to introduce new bills for this year’s legislative session, produced an onslaught of proposals last week, submitting a whopping 1,378 bills during the holiday-shortened work week.
The numbers are even more dizzying when you realize that both chambers combined to submit 1,927 bills since Jan. 1, meaning 72 percent of the proposed laws were pushed through in the final four days of the session. What’s more, the bill count doesn’t include simple, joint or concurrent resolutions…
One bill that is not so subtle—and woefully shameful for its blatant disregard for the will of the voters—is Senate Bill (SB) 1306, authored by Mark Leno, D-San Francisco. The bill seeks to override California’s constitutional amendment declaring marriage as between one man and one woman. The state’s voters, more than seven million people, approved the amendment in 2008 through the highly contested, but successful, Proposition 8.
In addition, Leno’s bill would strip all references to “husband” and “wife” in the state’s Family Code, replacing them with the word “spouse.”
Now, they seek to eliminate all references to gender characteristics that are distinctly unique to males and females.

Let us suppose that the year is 2050, and the Church of the Divine Orgasm is now the most prevalent religion in the US.
Now, the CDO proclaims that people not having sex whenever they feel a mutual urge is showing defiance to the will of god. Therefore, anyone practicing celibacy is immoral, unethical, and completely destructive to the good order of society.
They pass new laws declaring it illegal for anyone to live a celibate lifestyle—including Roman Catholic clergy. To allow Catholic clergy to take vows of celibacy would be an attack on the institution of human freedom and equality, and would show disrespect for god. Lets us now suppose these laws pass by clear majority votes.
Would you then consider people who ruled those laws unconstitutional “black robed dieties” who are defying the will of the people by overreaching their judicial authority?
Tell me, why does the CDO have the right to tell people how they should order their lives within their own homes? And, if the Church of the Divine Orgasm should not have the power to ban vows of celibacy, why should legislatures today have the power to tell gay people they cannot order their personal lives as they see fit?

The polling data of public support pretty much sums it up:
A 2003 Wirthlin poll found that 57% of Americans supported a constitutional amendment to define marriage as the union of a man and a woman.
A 2012 United Technologies/National Journal Congressional Connection poll found that only 24% of Americans agreed that Congress should “pass a constitutional amendment to ban same-sex marriage in every state regardless of state law.”
