Life Legal is representing Craig Walterscheid, a faithful pro-lifer who was arrested and issued a citation for felony vandalism for sidewalk “chalking” outside a California abortion clinic. The practice of using washable chalk on public sidewalks has always been a protected form of speech. But apparently First Amendment protections don’t apply when it comes to pro-life messages.
The pro-lifer used washable spray chalk to write out “Abortion is Murder” and “2363.org” on the public sidewalk outside the abortion mill. 2363.org is a campaign to raise awareness about the number of babies killed daily through abortion.
Life Legal attorneys are working diligently to get these ridiculous charges dismissed. Spray chalk is frequently used in various types of protests, artwork, and even children’s games – yet none of the individuals involved in those activities has faced prosecution and persecution as Mr. Walterscheid has.
Pre-trial in the case is set for February 8, 2023.
Unfortunately, this is yet another example of official discrimination against pro-life speech and activities. Two weeks ago, we reported that several men fired pellet guns at pro-lifers outside a Planned Parenthood mill in Napa, California. A number of individuals were hit by the pellets, including Life Legal CFO Mary Riley, who prays daily at the abortion clinic. Thankfully, no one was injured, but the victims were shaken by the attack. We have demanded an investigation into this hateful assault and even provided law enforcement with video evidence of the pellet gun shootings. However, Napa PD has failed to make this a priority and has not yet filed charges against the shooters. We are evaluating all legal options in this matter.

You don’t have a right to deface public property. Obey the law, prolifers. Chalking the sidewalk is not protected speech as these third-rate lawyers claim. California law says that any person who maliciously, with respect to any real or personal property not his or her own, defaces it with inscribed material, is guilty of a crime. This man is going to do the time for his crime.
hah! remember when the white elite BLM supporters used latex paint on city streets to paint giant “Black Lives Matter” and “Defund the Police”….it’s as if these people don’t realize they’re talking out loud…sheesh…

And, this man did not maliciously put washable chalk on the sidewalk any more than do children.
Maliciously: in a manner characterized by malice or ill will; with intent to do harm. Mr. Walterscheid did not harm (or intend to harm) anyone and does not have ill will. He does not deserve prison time, which is a possibility with felonies. Those killing children and violating girls and women behind the sidewalk are the ones who should be put away.
You seem more worked up by chalk on the sidewalk than mass murder nearby. Is that correct?

Two wrongs don’t make a right
the delusion is strong in this one…..as far as the city gov’t and police are concerned, there was only one ‘wrong’ and one ‘right’…appeals to ethics and morality ring a little hollow when the biggest ‘wrong’ is the taking of innocent human life and the objection is around some guy writing in chalk on a sidewalk…spare us the gaslighting…

I was thinking yesterday, what will be illegal next, parents hauled off to jail for painting Hopscotch on the sidewalk for their children, or hauling off children to juvenile hall for doing the same? The only graffiti my grandmother would allow me to do was chalk writing for Hopscotch because it could be easily washed off, and that is the only graffiti I have ever done. These people soooo hate decent family fun that they would do anything to destroy such families. May God “reward” them accordingly.
I don’t know of Christians or those who value life asking for special treatment. Yet, we are asking for equal treatment under the law. We are supposed to be a nation with rule of law. How can anyone justify letting BLMers and others use spray paint, not chalk, not only on sidewalks and streets, but on buildings, statues and monuments with impunity and yet claim prolife chalk is a felony deserving of prison time? The content of political expression should not determine the severity of the punishment. If those in power like the message, no charges. If they don’t, it’s a felony. That’s wrong, legally and ethically, regardless of who is in power at any given time.
