Democratic senators have argued that overturning or otherwise limiting Roe v. Wade would pave the way to change the size or structure of the high court, The Hill reported Monday.
The Supreme Court agreed last week to take up the case of Jackson Women’s Health Organization v. Dobbs, which concerns a Mississippi state law banning most abortions after 15 weeks of pregnancy. The court indicated it will consider one question in the case: “Whether all pre-viability prohibitions on elective abortions are unconstitutional?”
The legal question, as well as the court’s decision to take up the case, has prompted speculation that the justices could re-consider the 1973 Roe v. Wade ruling that legalized abortion nationwide.
In Roe, justices ruled that states could not outright ban abortion before viability, but they could regulate abortion in the second trimester of pregnancy. In its 1992 Planned Parenthood v. Casey decision, the court ruled that states could also regulate abortion pre-viability, but they may not place an “undue burden” on women seeking to undergo an abortion.
Sen. Richard Blumenthal (D-Conn.), a member of the Senate Judiciary Committee, told The Hill that if the court were to overturn or undercut Roe, it “will inevitably fuel and drive an effort to expand the Supreme Court if this activist majority betrays fundamental constitutional principles.”
“It’s already driving that movement,” Blumenthal added….
Sen. Sheldon Whitehouse (D-R.I.), another member of the Judiciary Committee, likewise told The Hill that the court’s review of the Mississippi law “really enlivens the concerns that we have about the extent to which right-wing billionaire money has influenced the makeup of the court and may even be pulling strings at the court….”
The above comes from a May 24 story on the site of the Catholic News Agency.
It sounds like Senator Blumenthal is saying that the function of the Supreme Court is about power – not about jurisprudence.
I’m happy that he finally leveled with us — It seems there’s totalitarian born every minute.
That is Senator Stolen Valor Blumenthal.
Yea, the ‘Nam Vet who wasn’t.
Why don’t they pass a law?
““will inevitably fuel and drive an effort to expand the Supreme Court if this activist majority betrays fundamental constitutional principles.”” May I ask Richard Blumenthal what fundamental constitutional principles he has in mind? Recreational sex is so mainstream now — it is incomprehensible to a great many to think of sex any other way — that abortion is essential to keep this lifestyle viable. The warnings of Humanae Vitae went unheeded and the all too predictable result is the present disaster where killing pre-born babies is acceptable collateral damage for the sake of enshrining aberrant sexuality as normal.
will inevitably fuel and drive an effort to expand the Supreme Court if this activist majority betrays fundamental constitutional principles.” I didn’t know murdering babies was a constitutional principle …Sicut Judaeis Non
Bohemond,
Unrestrained killing is a constitutional right . . . in Hell.
On Earth, It’s one of Satan’s key parameters in his quest to thwart God’s plan.
Can anyone really deny the demonic nature of abortion? That baby killing fanatics will stop at nothing to keep such a horrific practice in place shows the depth of their hatred for God.
This Blumenthal demon proves your point.
Nothing is more important to him that unlimited baby murder.
He is an example of “perfect possession”.
to DeusVult:
God bless you for your post.
NO ONE in their right mind can contemplate much less witness, without vomiting, the tearing of an innocent unborn from its mother’s womb. It is indeed demonic. We have the ASPCA to prevent abuse of animals–and that is good, but we outlaw protecting the unborn, who in their earliest stages possess every gene unique to a fully-grown human. So why do so so many [especially elected officials] possess this flippant rage to murder innocents? Could it be that abortion afficionados–and the society at large–have disguised murder by using terms such as “zygote”, “embryo” and–in late stage abortions when the unborn child is unmistakably human–by calling the abortion remains “the products of conception” Those are the euphemisms always used by the print and other media. Never, never call it an “unborn child”!
For ages unto ages, Satan has been called “the father of lies”. You need only watch your TV, read a newspaper, or listen to a “woke” political speech to verify how perfect that title is.
Pres Roosevelt tried to pack the court in the late 1930s. That did not go well, and failed miserably. I hope the politicians realize an effort to pack the Court may well result in voters sending them packing in the next election cycle.
American politics is a swinging pendulum, sometimes with enough energy to go to the extreme ends of the arc. We have had nine justices since a long time. When one party doesn’t like court decisions, they threaten to pack the court. They forget that the pendulmn will swing back before long. It always has. Remember when Republicans were liberals and Democrats were conservatives? If you pack the court now, the opposing party will pack with their folks the next time around, and there will be a call for more packing. Leave the cour alone. It is one of the few institutions we have left that hasn’t been trampled upon.
Once again Bob One and lukewarmness. Conservatives have not threatened to pack the court; you guys have; the left does that. Said it before, will say it again.. the only solution is break up of US into confederations.
