California’s Life Legal Defense Foundation achieved a significant victory in a whistleblower action filed against Danco, which manufacturers the deadly chemical abortion pill Mifepristone. Danco was created specifically to import and distribute Mifepristone under the name Mifeprex. The lawsuit was brought under the False Claims Act and alleged that Danco mislabeled the abortion drug, which it imports from China, resulting in significant financial losses to the U.S. government.

After a thorough investigation, Danco admitted to its failure to pay the required Customs Duties on the imported pills, which it failed to label with the country of origin. As a result, Danco has agreed to reimburse the government $765,000 under the False Claims Act, which allows whistleblowers to bring lawsuits on behalf of the government.

This victory comes on the heels of a separate ruling by a federal judge in Texas, who determined that the U.S. Food and Drug Administration (FDA) should never have approved the chemical abortion pills. The judge expressed grave concerns about the FDA’s failure to address safety issues as it systematically deregulated Danco‘s abortion drug — something the FDA had not done with any other drug. The judge’s ruling notes that the “FDA abandoned its safety proposals and acquiesced to the objections of the Population Council and Danco.” The Population Council, which was founded and funded by John D. Rockefeller – an outspoken eugenicist – sponsored the abortion drug.

Life Legal’s Chief Legal Officer Katie Short commented on the outcome of the case:

“We are pleased with the result of this qui tam action, which holds Danco accountable for its unlawful conduct. The recent ruling from Texas on the FDA’s politically-driven approval of these dangerous pills underscores the need for rigorous oversight of pharmaceutical companies, particularly those that, like Danco, exist only to peddle death.”
