A July 16 City Journal article entitled “Perverting Justice” reported “Early this year, Los Angeles police arrested Mark Berndt, a longtime teacher at Miramonte Elementary School, on 23 counts of committing lewd acts on children between the ages of seven and ten. The sickening details of the crimes Berndt is charged with committing horrified the community and the state.
More stories about California teachers accused of sexual misconduct with children have now surfaced. The Berndt case casts new light on the tortuous legal process that makes it nearly impossible for schools to rid themselves of even these depraved teachers. Perversely, the case also shows the extent to which teachers’ unions will go to protect their prerogatives….As a result of Berndt’s indictment, the Los Angeles Unified School District asked the state legislature to change existing law to speed up the process of removing such teachers.”
The legislation the LA school district asked for, Senate Bill 1530, was introduced in April by Democratic state senator Alex Padilla. The bill sailed through the state senate, passing with a 33-4 majority. The four “No” votes were all Democrats: openly homosexual senator Mark Leno of San Francisco; senator Ted Lieu, of the 28thDistrict, who earlier this year introduced SB 1172, which banned therapy to help same-sex attracted persons remove the unwanted feelings; Senator Rod Wright of the 25th District, whose sexual harassment case was settled in April, 2010 through a secret senate-approved payout of $120,000 in taxpayer money; and senator Leland Yee of San Francisco, a recipient of the Building a State of Equality Award from the pro same-sex-marriage group Equality California.
Following SB 1530’s passage in the senate, it went to the Assembly education committee. A majority vote was needed in the education committee for SB 1530 to go to a full vote on the Assembly floor. The committee consists of 11 Assemblymen, so six votes would be needed. All four Republicans and one Democrat voted in support. Of the six remaining Democrats on the committee, two, the open homosexual Tom Ammiano from San Francisco and Joan Buchanan from the East Bay (rated by Project Vote Smart as 100% Planned Parenthood, 100% NARAL, 100% Equality California), voted no. The other 4 Democrats on the committee refused to vote at all. The result: SB 1530 was dead.
The day after the June 27 vote to killing the measure, the Associated Press published an article entitled “Defeat of Calif. Teacher Bill Shows Union Power.” Reporter Christina Hoag wrote: “Mayor Antonio Villaraigosa slammed it as ‘cynical political manipulation,’ Los Angeles schools Superintendent John Deasy termed it shameful, but for the California Teachers Association, it was a victory.
The defeat Wednesday of a proposed law that would have made it easier for school districts to fire teachers in cases of sexual and other egregious misconduct has shone a spotlight on the strong sway of the California Teachers Association, widely considered the state’s most politically influential labor union with more than 325,000 members.
The AP included the “sickening details” that the City Journal article alluded to: “Prosecutors say Mark Berndt blindfolded students and fed them his semen by spoon and smeared on cookies in what he told them was a ‘tasting game.’ He has pleaded not guilty. Police found hundreds of photos of pupils and said he’d been engaged in the activity for years. The case only came to light when a drugstore photo technician spotted the odd images and reported them to authorities.”
Berndt was removed from the classroom in 2011, as the L.A. Sheriff’s Office began its investigation. He appealed his firing. Rather than enter into the current “tortuous” (and expensive) teacher’s appeal process, the L.A. school district offered Berndt $40,000 to resign. He accepted.
Unlike many years ago, in many cases there is no longer a need for UNIONS in the USA. Today there are laws such as minimum wage, OSHA laws for safety, and much more depending on the State. Union dues are used to support pro-abortion evil Democrats, and evil Democrats who support child abuse as seen above. They have become nothing but political arms of the Democratic Party with forced membership in order to work. The California Teachers Association should be outlawed. Having to use CA taxpayer dollars to buy-out rather than fire teachers in cases of sexual and other egregious misconduct – shows that UNIONS are becoming evil in themselves.

What is urgent and destructive has been the way the Church leadership, from the papacy on down to local bishops, have responded. “For the good of the Church” victims have been ignored, silenced and rebuffed, and criminal offenders have been quietly sent off to new assignments, often to offend again. “For the good of the Church” those harmed by the clergy have been led to cooperate in their own exploitation, convinced by their trusted leaders that the institution’s image and the exalted status of the priests is of greater value than healing or justice. Though other institutions, public and private, religious and secular, have all experienced sexual abuse and other forms of internal corruption, the Catholic Church is unique. It has used its immense spiritual power and its absolute authority to control victims to the extent of persuading them to be part of their own cover-up.

This reminds me of a scandal in Germany a few years back. There were two sexual abuse cases. One was committed by some clergy members of the Catholic church. The second was, upon investigation, just the tip of the iceberg in the so called Odenwald School, a far left wing school for future political leaders.

While I do not agree with the unions position in this particular case, I have been in union and non union call centers, while some places may not ne union neccessary (mac convinience stores comes to mind) I believe unions do their job protecting employees, without a union there is no law against firing an employee for any reason they feel like. Some unions have too much power, but WHO allowed them to be so powerful in the first place?
With the likes of Leno, Lieu and Wright in the legislature, there is no chance that children will have any protection or due-process in cases of sexual assault. I am a Catholic school teacher with over 30 years classroom experience and appreciate the legitimate concerns of teachers regarding false or exaggerated claims. Nevertheless, public school teachers should have not more protection than other civil service employees.

Los Angeles (CNN) — The Los Angeles Unified School District board on Tuesday fired Miramonte Elementary School teacher Martin Bernard Springer just hours after he was formally charged with three felony counts of lewd acts upon a girl under age 14, a school spokesman said.
Springer, 49, of Alhambra, California, has 30 days to appeal his firing, school spokesman Tom Waldman said.
Springer pleaded not guilty late Tuesday afternoon in a Los Angeles County court to three felony counts of lewd acts on a child over three months in 2009.
The judge set his bail at $300,000 on the condition that Springer stay more than 250 feet away from witnesses and alleged victims, stay more than 100 feet away from any school or facility with children and be with an adult supervisor when he’s around children.
Springer’s preliminary hearing is scheduled for February 16.
Springer was the second teacher at Miramonte charged with lewd conduct with pupils.
Former Miramonte teacher Mark Berndt, 61, was arrested and accused of taking bondage photos of more than two dozen students in his classroom, including some with suspected semen-filled spoons at their mouths.
The school board fired Berndt a year ago; Berndt appealed but he dropped the appeal and resigned last spring, Waldman said.
On Tuesday, the school board also fired a third teacher, music teacher Vance Miller at Hamilton High School, in the wake of unrelated allegations of sexual misconduct with students, Waldman said. Miller could not immediately be reached for comment Tuesday.
The school board unanimously approved the two latest firings during a closed session and announced its decisions publicly afterward, Waldman said. They called the Cops and look what happened.
The three counts against Springer involve one girl who was identified only as “Jane Doe” and “under the age of 14 years.” The complaint alleged the crimes occurred in April, May and June of 2009, the Los Angeles County District Attorney’s Office said.
If convicted, Springer would face a maximum state prison term of 12 years, prosecutors said.
Springer was arrested Friday and accused of fondling two girls in the classroom, but Tuesday’s charges involve only one alleged victim.
Berndt, who taught for 30 years, is being held in lieu of $23 million bail: $1 million for each of the 23 counts he faces of lewd acts on a child.
When asked about the difference between Springer’s $300,000 bail and Berndt’s $23 million bail, spokeswoman Sandi Gibbons of the Los Angeles County District Attorney’s Office said the charges against Berndt are more serious, involving bondage, for example.
Meanwhile, students at Miramonte Elementary School returned to class to a new staff, because administrators do not want any more “surprises” at the Los Angeles school that is at the center of two child abuse cases. Looks like total panic, although they are now calling the Cops.
Staffers and students will be questioned as part of the ongoing criminal investigation.
Parents will also be given the option of transferring their children to one of four elementary schools in the area.
“The actions we are taking are not a condemnation of the entire staff,” Deasy said.
The moves weren’t enough to appease outraged parents, who are demanding additional safeguards for the students.
“We’re saying enough is enough,” community leader Morris Grifton said at a demonstration Monday. “We want cameras in the classrooms, in the hallways and around the school.”

Daily News: Most of the principals made the deadline, and the California Commission on Teacher Credentialing was flooded with files – 591 by May 12, the most recent count the state could provide. Officials said 103 of the allegations had previously been reported and the agency lacked the authority to handle 122 others.
That leaves 366 to be formally investigated, a number that is likely to climb as principals wrap up their work and the district transmits more files to the teacher licensing agency.
The commission has 31 staff members to work on investigations, which typically take six months to complete. That means it could take years for the LAUSD cases to be

“Protecting California’s schoolchildren is always a priority for the commission,” Executive Director LAUSD Mary Vixie Sandy said in a statement. “The workload has been a challenge, but a necessary one.”
(The Commission not the Union)The commission has the authority to suspend or revoke a teacher’s credential for sexual misconduct or other inappropriate behavior. According to state Education Code, it has up to four years from the date of the alleged misconduct to take action.
Under the current contract with LAUSD’s teachers’ union, four years is also the length of time that unsubstantiated allegations of misconduct can be retained in a employee’s personnel file. After that, it must be kept in a separate “expired” file.
District spokesman Tom Waldman said files submitted by the principals were reviewed independently by two staff members in the Human Resources Division. If just one of the staffers considered the conduct questionable, the file was forwarded to the credentialing panel for consideration.
Previously, just one person was responsible for making the decision, Waldman said.
That protocol is also being used to process new allegations of wrongdoing.
“We made a promise to parents that we’d change the system to protect their kids, and we’ve fulfilled that promise,” Deasy said Wednesday. “We’ve implemented an entirely different protocol for reviewing files, so we’ve got two sets of eyes to look at them.”
Deasy has said he wanted to be sure there was no lapse like the one that occurred when Los Angeles Unified waited a year before notifying the state that it was firing Mark Berndt, the Miramonte Elementary teacher charged with committing lewd acts with nearly two dozen students.
Berndt was fired in February 2011 after officials learned the Los Angeles County Sheriff’s Department was investigating him for suspected sex abuse.
Deasy subsequently ordered his staff to refile four years worth of misconduct reports to the state.
He also ordered a top-to-bottom review of campus personnel files, which he later narrowed to 40 years. Even then, he had to extend the deadline twice because the review proved so time-consuming.
“It was absolutely worth it,” Deasy said. “We can never again have a situation where teachers are in a position to do harm to our students.”
Judith Perez, executive director of the Associated Administrators of Los Angeles, said principals were also committed to students’ safety, although she questioned the scope of the review.
Some administrators, she said, had to excavate files from school attics, basements and campus outbuildings, while others lacked the technology to convert the paper files to a digital format. And records of teachers who had died or left the district years earlier had to be sent in, along with those containing more recent allegations.
“Is it worth it to go back 40 years? I wonder,” she said. “The urgency would be active concerns, those within the statute of limitations,” she said. “Beyond that, it’s not clear to me why.” … The LAUSD doesn’t need a new law, when all they have to do is call the Cops

Over the course of my years of involvement with the clergy sexual abuse “happening” I have learned that the damage done to the spirituality of the victims has been considerable and in many ways, more difficult to deal with than either the emotional or psychological damage. The victims are not alone in suffering grave spiritual damage. Many of those directly or even indirectly involved with this whole complex phenomenon have found themselves in a growing quandary with their belief systems. I am one of them. For years my belief system and the objects of my faith were gradually shifting, often in ways I did not even notice. Most of what I had been taught about Faith, about Beliefs, about Trust in the human or earthly dimensions of the community of believers, the institutional Church, came under assault. I had believed what the official church had told me without much questioning. I accepted that the Church was what it was and I bought into all of the standard explanations for the historical departures of the institutional Church and its leaders from basic Christian decency and certainly from honesty…like the inquisition, the crusades, the approval of slavery, the colonization of the new world and the Vatican’s diplomatic ties to Hitler and Mussolini. My serious questioning started when I found myself on the inside looking out as the clergy sex abuse scandal started to unfold back in 1984. As I saw first-hand the duplicity and institutionalized lying of the self-proclaimed “successors of the Apostles” I slowly began to wonder if the apostles weren’t actually a cabal of anti-Christian dolts or on the other hand, I wondered if the infallible connection between the popes, bishops and church monarchy was neither infallible nor divinely willed.
I know a victim who was priest who will no longer set foot in a Catholic church, not because of the abuse, but because of how he was treated by his own bishop when he told.

i firmly believe that people in crisis should always “seek a second opinion” so that one person’s nuttiness will not ruin their lives; for example, some friends have said a priest would not even talk with them about an annulment because the priest didn’t “believe” in annulments – but when they apporached as second priest at my urging they found they had a very good case for solid catholic reasons.

The teachers union can’t stop the firing of a child rapist. What makes you people think that teachers would support child molesting in the LAUSD. There is nothing in the union contract that allows for child molesters to thrive in the LAUSD let alone a teacher that would ever condone it. In 1990 two girls reported very strange behavior of Mark Berndt to a school administrator and that administrator blew them off. They are both about 30 now with very good careers. One has a PHD. They brought this up to LAUSD and they can’t find a record(s) of the complaint. The Sheriffs Dept. was also involved and they blew them off as well. They can’t locate a record of the incident as well. After 30 years the LAUSD Commission fired him after a Sheriffs investigation. A photo developer employee tipped them off. The Superintendent of LAUSD could not understand how this could have happened. This should be no surprise to those that read CCD. It’s called a coverup. The Superintendent is launching a full investigation to bring out the truth. I hope that all the perpetrators and their enablers all get what they deserve. Every allegation needs to be investigated fully. This perp has 23 counts against him. A bogus law to target the teachers was not necessary to bring this monster down. It can amount to a felony for a school worker who notices the possibility of abuse and does not report it.
Should the worker get a mulligan for letting the abuser to continue to abuse or should it be made clear that this will no longer be accepted.
It is a felony for a school worker not to report suspected or evidenced child abuse. If an employee of a public school in California is aware of some clue of possible child abuse and does not report it, and it turns out to be a child abuse case, then that worker is subject to a felony charge for ignoring it. The worker has to report suspected child abuse, and if he or she fails to do so … and has no involvement in the abuse … they are subject to a felony charge. Eg, you the employee sees a kid with bruises and you ignore it, and it turns out to be abuse, and when all the testimony hits the fan and they find out you ignored it, you need to hire a criminal lawyer asap.
According to a June 23, 2006 report by the Monterey Herald (included at end of this message), Ochoa on Friday, April 28 notified Bishop Walsh that he had sexually abused a 12-year-old boy. Charges against Ochoa include sodomy, oral copulation and lewd conduct with a minor. Good luck prosecuting him now that he’s south of the border.
However, instead of calling a 24-hour sexual abuse hotline — as required by diocesan policy — to immediately report the molestation, Bishop Walsh turned the matter over to diocesan attorney Dan Galvin who waited until Monday, May 1 to fax a letter to Child Protective Services and to notify the local Sheriff’s department the following day, May 2 — allowing Ochoa plenty of time flee.
The Monterey Herald further reported, “It was unlikely that church officials would face criminal charges for the tardy reporting, he [Passalacqua] said.
**No criminal charges were filed. Bishop Walsh was ordered to attend retraining classes on mandatory reporting. That was it. In fairness, Bishop Walsh did not receive any special treatment for being a tardy mandatory reporter. This unfortunately happens more often than not. JLS, don’t worry so much about a employee receiving a charge (felony) for a mandatory reporting violation. It just doesn’t happen very often if at all.
A law that merely allows for firing of teacher child molesters and other very grave offenses would harm no law abiding teacher. It costs the taxpayers hugh sums of money to remove law breaking teachers who have tenure. It was stupid of the Union to fight this law. In addition, lousy and lazy teachers should not be rewarded, only teachers who do a decent and good job – says I – a taxpayer.

Criminal justice system is accurate and fast in California. However the LAUSD will not report to the District Attorney the commission of crimes for it likes to use these crimes of teachers as bargains for obtaining additional funding and for paying its favorite private lawyers pursuing more an administrative case instead of criminal one.
If a teacher commits misconduct which could be crime then let the Criminal Justice System takes over, and if the teacher is guilty, he is convicted in less than a month and he can therefore immediately be dismissed from teaching. LAUSD causes the delay for some ulterior reasons or in short for money.

Seems like the public school unions are following the lead of church leadership. Protect the perv. They do it with unions, the church has done it(forever) with out of the way parishes or vineyard retreats. Just ask Bellarmine in SJ. Kids need to be protected, no matter what the educational setting is and how much power and influence the protecting parties have.

BELLFLOWER — A 13-year-old molestation victim pleaded with a judge Monday to give Kumon Math & Reading teacher who molested her “what he deserves.”
“I’m not confident, I’m not comfortable socializing with anybody and it’s hard to trust people,” said the girl, whose name was withheld because she is a victim of a sex crime by her Kumon teacher.
Her statement came at the sentencing of her attacker, Frank Chung, a 63-year-old local man who molested her and allegedly two other girls at his Norwalk Kumon Math & Reading tutoring business.
“I just want what he deserves,” the victim calmly but quietly told Bellflower Superior Court Judge Leland Tipton moments before Chung was sentenced to eight years in prison.
The 13-year-old victim is one of three girls who told authorities they were attacked by Chung at the Kumon Tutoring Center, and she was the first victim to come forward, said Los Angeles County Sheriff’s Department Detective Rudy Acevedo.
Chung was arrested Sept. 8, and charged with lewd acts with a minor based on the allegation he molested the 13-year-old on a number of occasions at the Kumon learning center.
When news of his arrest broke, the other two victims came forward and additional counts were added to the charge, Acevedo said.
As part of a plea agreement reached last month, Chung pleaded no contest to a single count related to the first victim in exchange for eight years behind bars.
Defense Attorney Rayford Fountain noted at sentencing that his client received a number of letters of support from colleagues and friends and asked the prosecution and the court to consider lowering the sentence time.
“Many people have stood up for him,” Fountain said.
I have two uncles who were sexually abused within the Catholic Church and yes, we can bring it up anytime anywhere! We need every generation to know it can happen!
