The Biden administration on Tuesday, June 8, said it is required by law to uphold a Title IX exemption for religious colleges, in response to a lawsuit filed by students identifying as LGBT.

Filing in an Oregon district court, the Justice Department said that religious post-secondary schools seeking to intervene in a case to defend their Title IX religious exemption are not entitled to do so; the colleges have not made a “compelling” case that the federal government won’t defend their religious exemption in court, the Biden administration argued.

In the case of Hunter v. U.S. Department of Education, the pro-LGBT Religious Exemption Accountability Project in March filed a lawsuit on behalf of 33 current and former students from more than 20 colleges associated with evangelical Christianity and the Church of Jesus Christ of Latter-Day Saints.

The students, who identify as LGBT, said they experienced discrimination at the schools on the basis of their sexual orientation or gender identity. The schools, they argued, should be subject to the Title IX prohibition on sex discrimination – which the Biden administration interprets to include discrimination on the basis of sexual orientation and gender identity. Title IX includes an exemption for religious colleges and universities.

In response, two Christian universities and one seminary – as well as the Council for Christian Colleges & Universities – in April moved to intervene in the case to defend their religious exemptions. The three schools – Corban University, William Jessup University, and Phoenix Seminary – are represented by the group Alliance Defending Freedom.

In a court filing reported by the Washington Post on Tuesday, the Biden administration argued that the colleges should not be able to intervene in the case, because they have not proven that the administration would not adequately defend their religious exemption in court.

The Justice Department stated that “at this stage of the litigation, it is premature to conclude that the Federal Defendants would neglect to raise, or be ‘ill-equipped’ to develop, effective arguments in support of the Religious Exemption….”

    Remember when they said all they wanted were civil unions? That was a lie. It was the same with wanting a color-blind society in treating minorities, but now they push critical race theory, which says all whites are bad. They lie at first to get small concessions, then when when they think they can win, they push for a huge power grab to oppress their enemies.

    Mark my words. Joe Biden is no friend of religion and he isn’t a devout Catholic.

    I think I’ll apply for admission to a historically black college and see if I am discriminated against because of my race.

      25% of those who attend HBCUs are not black. So go for it. Especially if you can self-pay.

    I am in a long term heterosexual marriage. The several gays I know do not seek to ”completely overthrow the moral order.’ Rather, they seek to ‘do their thing’ in private and in peace. Others are free to do otherwise.

      Luckily Mike M I don’t know several gays, however I am under constant assault by them letting me know how oppressed their are with their corporate sponsorships And if you dont think the moral order is overthrown.. go out into the street with a sign reading marriage is between a man and woman and let me know what happens to you

    Wow…you can just hear the sneering smile of the Administration when they say, “give us a chance…we’ll defend you…” Demonic…they’d no sooner defend these schools than a scorpion wouldn’t sting…the alarming thing is that they know *everyone* knows they’re lying…

    Gay students -If you don’t want to be Catholic, Christian, or act like one, and don’t believe in the Bible, and in the Catholic Catechism, then why don’t you go to a Sectarian public Grammar school, High, school, and public College?
    You very well know that Catholics cannot change the basic scriptures, or their moral behavior, as clearly stated in the Bible.
    Gays, why don’t you just leave? Are you just in a Catholic Institution, for your real cause – to trouble and attack Catholics?
    Leave!! We are sorry the Catholic life is too difficult for you. You made your choice. Don’t expect us to change.
    We wish to be Catholics adhering firmly, and in truth, to our faith. We don’t expect you to follow, and we know your reason for attending a Catholic Institution is solely to force Catholics to justify your gay way of life.
    You made your choice. Gays – you have your own way of life – to behave as you wish.
    Let us celebrate our Catholic Faith as stated in the Bible, It’s called Freedom of Religion.

    I do not get it…If anyone (no matter what your sexual preference) is unhappy with the college they should change colleges. .
