The Archdiocese of Washington, D.C., is arguing in a new lawsuit that the Obama administration is engaged in a “conscious political strategy to marginalize and delegitimize” Catholic “religious views on contraception by holding them up for ridicule on the national stage.”
At issue in the lawsuit is whether the administration can force the archdiocese to secure a third-party administrator for its self-insurance plan who will provide sterilizations, contraceptives and abortion-inducing drugs at no cost to church employees at some of the archdiocese’s separately incorporated subunits.
These subunits include a number of Catholic schools and charities, including Archbishop Carroll High School and Catholic Charities of Washington.
“[T]he Archdiocese operates a self-insurance plan that encompasses not only individuals directly employed by the Archdiocese itself, but, in addition, individuals employed by affiliated Catholic organizations,” says the church’s lawsuit.
Because the Obama administration’s sterilization-contraceptive-abortifacient mandate does not deem these Catholic organizations to be “religious employers,” says the lawsuit, “the U.S. Government Mandate requires that the archdiocese either (1) sponsor a plan that will provide, pay for, and/or facilitate the provision of the objectionable products and services to the employees of” these church organizations “or (2) no longer extend its plan to these organizations, subjecting them to massive fines if they do not contract with another insurance provider that will provide the objectionable coverage.”
Lawyers representing the archdiocese filed a memorandum with U.S. District Judge Amy Berman Jackson on Sept. 24, pointing to actions and statements made by Health and Human Services Secretary Kathleen Sebelius to demonstrate that the administration is deliberately targeting the Catholic Church for its religious views….
“The record, moreover, establishes that the mandate was part of a conscious political strategy to marginalize and delegitimize plaintiffs’ religious views on contraception by holding them up for ridicule on the national stage,” says the archdiocese’s memorandum.
“For example,” the archdiocese says, “at a NARAL Pro-Choice America fundraiser, Defendant Sebelius stated: ‘Wouldn’t you think that people who want to reduce the number of abortions would champion the cause of widely affordable contraceptive services? Not so much.’”
“Likewise,” the memorandum continues, “the original definition of ‘preventive service’ was promulgated by an Institute of Medicine Committee that was stacked with individuals who, like Defendant Sebelius, strongly disagreed with many Catholic teachings, causing the committee’s lone dissenter to lament that the committee’s recommendation reflected the other members’ ‘subjective determinations filtered through a lens of advocacy.’”
“This anti-religious bias,” says the memorandum, “is further confirmed by the fact that it was directly modeled on a California statute, see 77 Fed. Reg. at 8726 (explaining that the federal Mandate was modeled on state law); … whose chief legislative sponsor made clear that its purpose was to strike a blow against Catholic religious authorities: ‘59 percent of all Catholic women of childbearing age practice contraception.’ ‘[88] percent of Catholics believe . . . that someone who practices artificial birth control can still be a good Catholic. I agree with that. I think it’s time to do the right thing.’”
“Thus,” says the memorandum, “not only the ‘real operation’ but also the intended effect of the mandate is to target and suppress plaintiffs’ religious practices.”
The sponsor of the California legislation cited in the archdiocese’s memorandum was Jackie Speier, who formerly served as a member of the California state senate and is now a member of the U.S. House of Representatives.
In 1999, Speier pushed legislation in the California state legislature that required any health care plan that covered any prescription drugs to also cover artificial contraceptives.
A study done by PriceWaterhouseCoopers at that time discovered that “coverage of reversible forms of contraception is available to approximately 90 percent of insured Californians.” Catholic organizations—which adhered to the teaching of the Catholic Church that artificial contraception is intrinsically immoral–stood conspicuously outside that fold.
Speier’s California legislation included a very narrow exemption for religious organizations that was essentially limited only to houses of worship–leaving out Catholic charities, hospitals and schools. The original wording of the religious exemption in the Obamacare sterilization-contraception-abortifacient regulation issued by the Department of Health and Human Services was modeled on this California exemption.
Like HHS Secretary Sebelius, Rep. Jackie Speier is a Catholic, who, in contradiction to the church teaching, ardently advocates legalized abortion.
In May 2008, Archbishop Joseph Naumann of Kansas City publicly warned Sebelius she must refrain from taking Holy Communion until she recanted her support for abortion and went to confession.

Catholics targeting Catholics – Quislings all. Protestants or atheists all. After being figuratively smacked so many times, one would think kicking these CINOs out is WAY past due, but I guess not with most of the bishops we have now.
I suspect that very few Catholics, including clergy could explain WHY contraception and sterilization is evil. This of course IS the problem. Until Catholics and others understand the “why” and not just the “is”, there will be rejection of this teaching. The truth is usually attractive to most if understood. Without this “knowledge”, most people will embrace what is “convenient” even when what they embrace is pure evil.
And to think Jackie was 3 years ahead of me at Mercy High School in Burlingame!
I pray for her and all the other so called ‘Catholic’ politicians frequently…. for them to come back in ‘full communion’ with the Church and Her teachings…….
I think the Archbishop should round up Jackie, Nancy and a few other politicians who are on City Councils in the archdiocese and talk to them ‘like a dutch uncle’!
And at the very least, they should be told NOT to receive Our Lord in Holy Communion… and if they persist…….it’s OVERTIME for excommunication!
To think what? That Mercy High is above Speier? Why don’t you initiate some action to get Mercy to “round her up”? Good Luck. Mercy is just as big a problem as she is, endlessly touting her as a prominent alumnus. And get a clue, the bishops aren’t going to do anything either. They’ve had decades of this problem staring them in the face and all the harping typified by the comments here has produced exactly nothing. On a separate topic, Speier’s birthname is Karen, but “Jackie” derives from her unsaintly confirmation name choice of “Jacqueline,” after Jacqueline Onassis. She’s delusional from the get-go. Write that into the Mercy Alumni News. Maybe they’ll print it. NOT.
I would urge anyone who believes that contraception is evil, but can’t explain why, to educate yourself on this issue. I would also urge those of you who opposes the Church’s teaching about contraception, but can’t first thoroughly explain why She teaches as She does, also educate yourself on this issue. I have my own answer, Tracy. If I had taken the birth control pills one doctor gave me, I would have died or had a serious mutilating operation over twenty years ago since the pills would have exacerbated the cancer I had at that time, and most likely I would not have survived to be a senior.
According to Human Life International, this government is trying to force two child families on the Philippines. You know what that means, Chinese style forced abortions. No wonder President Obama and his administration is trying to bankrupt us.
Contraception is apparently evil because it interferes with God’s plan to give you as many babies as he gives you.
And this is rooted in Genesis 1:28: “Be fruitful and multiply”.
That’s great, but if the objective is to multiply, we’ve been incredibly successful at achieving it. Even since the widespread adoption of contraception (say 1970), the human population has gone from 3.7b to 7b, and is projected at 10b by 2050. There is an upper limit to the capacity of the Earth to accommodate us. It’s hard to imagine we’re not close to reaching that.
I know this is all dogmatized and thus unquestionable, but does anyone here even privately contemplate the rationality of having 8 kids? If we reach 15b people and start to be decimated by political instability and limited access to resources, do we credit God or ourselves for that?
Barnett, apparently you sadly accept the godless population controllers propaganda as fact over God’s infinite providence. As I said above, with lack of knowledge, most of us will gravitate toward what seems convenient. Now you have acknowledged that you are well versed in the “over population theory”. Based on your above post, I really doubt, however, that you have ever heard from those who have proven the OP theory to be false. The “Population Research Institute” is a great place to start. Their website is pop.org. They also have 2-3 minute youtube videos which cleverly debunk the overpopulation myth. These can be accessed at overpopulationisamyth.com, or search for them on youtube. I’d love to hear your opinion on the subject after you have become better informed.
Why haven’t Kathleen Sebelius and other Catholic politicians been publically excommunicated? They are viciously attacking the Catholic Church and Catholic doctrine. They give people the public the impression that the Church teaching is wrong, and some people will believe them. Isn’t there some bishop or archbishop with enough courage to show the world that these people are not practicing Catholics and that they are persecuting the Church and causing scandal? St. Thomas More refused to approve of the unlawful marriage of Henry VIII and lost his head for it. That’s courage.

Once again the Church behaves like an offended institution, appears not to see the work of the Devilish One, and speaks in public through the legal system . The shepherds are paralyzed or cooperative when seeing undisguised evil. Let us not forget that Thomas More was a man alone. Our progressive bishops are busy smiling and backslapping Democrats behind closed doors. Wuerl like his predecessor McCarrick has said he would not make political judgments at the Communion rail. Hey, if this were happening in New York, Sebelius might be the next guest of honor at the Al Smith dinner.
And did you notice that the Al Smith dinner last week had CINO Gov. Cuomo? Very little reporting of the dinner and the cardinal, of course. When are we going to have real bishops in this country?
It is well and good to fight the Obama Administration, and the apostate Catholics in the Federal Government, such as: Nancy Pelosi, Kathleen Sebelius, and Jackie Speier (and many, many others). However, even more important to recognize, and correct, is the marginalization of Washington, D.C., and many Maryland, Catholics under the administration of Cardinal Wuerl. Here is a man, in the mold of the “every-man liberal” of Cardinal Mahony, Bishop Trautman, and many others. No purported Catholic, no Kennedy, Pelosi, Biden, whomever, can do an act evil enough (establishing the funding of abortion rights, assisting homosexual sex and marriage, bah, harumph, no probelm) to be rejected at the communion rail. But, want to say a TLM? Teach of, and administrater, the sacraments in the “extraordinary form” — why this is an outrage, something not to be tolerated. Many, many young priests in this diocese, much like the adjoining Diocese of Arlington (VA), put their clerical careers in jeopardy by simply stating their intent to say the Traditional Latin Mass. Too bad that the Catholic bishopric leadership — can you say Cardinal Dolan — are doing all they can to virtually kick their jurisdiction of the Catholic Church down the road to complete loss of institutional destruction. We know that, ultimately, there will be a success of the Church, and that somehow God accepts the present leadership of the Church, but what an utter and total disaster Cardinal Wuerl, Cardinal Dolan, and the USCCB have been to their only true reason for being: the salvation of Mankind!
It would be more than helpful for the bishop, archbishop, cardinals in DC to publicly censure these two women, as well as publicly reinforce traditional Church teaching about contraception, that they give homely after homely about the irrational use of contraception in DC and in the Church in the US overall. We who attend mass regularly ought to hear this over and over until we all “get it” and therefore can let our brothers and sisters (whomever they be) know what the Church holds true, and then, hopefully everyone who hears and obeys the Church in Her teaching, will follow. It is irrational to have relations and expect to NOT get pregnant. Even birth control methods fail, and the pill as well as any other. The only “method” that is 100% effective is abstinence. Catch the Clue Bus, folks.
